Delhi Men Cell: 498A Case से बचने के लिए Court जाना बंद कर दिया तो?
“Case झूठा है… तो मैं Court में क्यों जाता रहूँ?”
कई परेशान husbands के दिमाग में यह thought आ सकता है.
लेकिन criminal matrimonial case में allegations का सामना करना एक problem है — और Court appearance छोड़ देना दूसरी problem.
A Delhi court judgment reported in March 2026 shows how these two issues can end very differently.
The accused, Zakir Hussain, was facing serious allegations under Sections 498A and 304B IPC in connection with the death of his wife, Noor Saba.
The prosecution case was that the couple had married on 9 August 2014 and that the wife later attempted suicide at their Uttam Nagar residence in July 2015 and died during treatment.
Her father had initially alleged mental harassment and a demand of ₹10 lakh for opening a shop, along with dowry-related taunts.
But during the trial, the evidentiary picture changed.
The wife's father did not support the prosecution case in court. He stated that the accused had never demanded money or dowry from him and that his daughter had not complained to him about harassment after he declined financial help for the proposed furniture showroom.
Other prosecution witnesses also failed to support the allegations.
The court therefore acquitted Zakir Hussain of the charges relating to dowry death and cruelty, finding that the prosecution had not established the necessary allegations beyond reasonable doubt. The court also found no material establishing abetment of suicide under Section 306 IPC.
But then came the completely different part of the case.
He was separately convicted under Section 174A IPC.
Why?
Because he had failed to appear before the Court despite proclamation proceedings, and he had been declared a proclaimed offender in December 2016.
यानी एक ही case में दो बिल्कुल अलग legal questions सामने आए:
“क्या 498A/304B का आरोप prosecution ने prove किया?”
और
“क्या accused ने Court process को obey किया?”
The answer to the first was no, on the evidence recorded by the Court.
But that did not automatically erase the consequence of his separate conduct concerning appearance before the Court.
This distinction is extremely important for a husband facing a Delhi matrimonial criminal case.
अगर आपको लगता है कि 498A allegation false है, evidence weak है, witnesses support नहीं कर रहे, या prosecution case में contradictions हैं — those are matters to be dealt with through the legal process.
लेकिन:
Notice ignore करना.
Summons ignore करना.
Bail conditions ignore करना.
Repeatedly Court में appear न करना.
फिर proclamation तक situation पहुँच जाना.
ये अलग risks पैदा कर सकते हैं.
और यही वह point है जहाँ एक harassed husband कभी-कभी सबसे बड़ी practical mistake कर देता है:
“Case झूठा है, इसलिए मैं Court नहीं जाऊँगा.”
No.
False allegation का defence और Court process का compliance — दोनों अलग tracks हैं.
Delhi/NCR में 498A case, dowry complaint, matrimonial criminal case, proclaimed offender issue, bail, summons and Court appearance जैसी problems के बीच documents और dates की पूरी chronology maintain करना बेहद important हो सकता है.
एक missed date को छोटा समझना बाद में बहुत बड़ा legal complication बना सकता है.

Court से दूर भागना और Court में अपने defence को properly pursue करना — दोनों बिल्कुल अलग बातें हैं.
Case-specific caution: This case turned on its own evidence, witness testimony and the accused's separate failure to appear after proclamation proceedings. His acquittal on the 498A/304B allegations did not amount to a general rule that matrimonial criminal allegations are false or that every accused husband who challenges such allegations will be acquitted. Likewise, the separate Section 174A consequence arose from the particular Court-process history recorded in this case.
