एक matrimonial dispute में सबसे confusing situation तब बन सकती है जब husband को अलग-अलग proceedings में maintenance demands का सामना करना पड़े.
एक recent Delhi High Court judgment ने इसी practical problem को address किया.
Court ने कहा कि अलग-अलग statutory proceedings में maintenance मिलने की स्थिति में amounts को properly adjust और set-off किया जाना चाहिए, ताकि एक ही financial obligation के लिए overlapping maintenance orders का असर न बने. The Court referred to the principles laid down by the Supreme Court in Rajnesh v. Neha.
यानी अगर एक husband पहले से किसी proceeding में maintenance pay कर रहा है, तो दूसरी proceeding में उस payment को ignore करके पूरा amount फिर से calculate करना simple matter नहीं है.
यह point खास तौर पर उन husbands के लिए important है जिनका matrimonial dispute Delhi NCR में कई forums तक पहुँच चुका है.
NRI husband हो, businessman हो या Delhi NCR में professionally settled husband — records को scattered छोड़ना बाद में परेशानी पैदा कर सकता है.
Keep a proper record of:
• हर maintenance application की date
• किस Court में proceeding pending है
• कितना amount ordered हुआ
• कितना actually paid हुआ
• payment की dates और bank proof
• कोई settlement या interim order
• parallel proceedings में मांगी गई relief
क्योंकि matrimonial case में कभी-कभी सवाल सिर्फ “maintenance कितनी है?” का नहीं होता.
सवाल यह भी होता है — पहले क्या pay हो चुका है, किस order के तहत pay हुआ है और किस proceeding में उसका adjustment होना चाहिए?
यही वजह है कि divorce lawyers in Delhi या divorce lawyers in Delhi NCR की तलाश करने वाले husband को केवल notice का जवाब तैयार कराने से पहले पूरा matrimonial record एक जगह रखना चाहिए.
NRI husbands के लिए online discussion भी practical हो सकता है, खासकर जब husband India में physically present न हो.
